Khanlar Valiyev appointed judge of the Constitutional Court; names of new judges announced

On April 11, the next plenary session of the Milli Majlis was held under the chairmanship of Sahiba Gafarova. The speaker first informed the deputies about her visit to Uzbekistan, the important meetings she attended, and the meetings held within the framework of the visit. She said that the delegation headed by the Speaker of the Milli Majlis was on a working visit to the Republic of Uzbekistan from April 4 to 7: “The purpose of the visit was to organize and participate in the fourth conference of the Non-Aligned Movement Parliamentary Network, as well as to participate in the 150th Assembly of the Inter-Parliamentary Union and the Coordination Meeting of the Asian Parliamentary Assembly held within the framework of the Assembly. Let me remind you that today the Speaker of the Milli Majlis chairs 5 international parliamentary organizations, and the Non-Aligned Movement Parliamentary Network and the Asian Parliamentary Assembly are two of them.”

The Chairman of the Human Rights Committee, Zahid Oruj, drew attention to the President’s recent messages: “At the ADA International Forum, a German researcher asked President Ilham Aliyev whether our state has any initiatives to normalize relations between Israel and Turkey? The question, of course, stemmed from the historical contributions of our country to regional and international security. The global order was achieved precisely in our capital with the US-Russia high-level meetings in 2017 and NATO-Russia in 2020. Our country’s reconciling role was recognized even when our territories were occupied. Economic, political and security ties between the Middle East, Central Asia and the South Caucasus pass through Baku: “The meeting of the heads of the secret services of Israel and Turkey, whose armies are facing each other in Syria, in our capital two days ago is an unprecedented event for global security. Our country is not under attack in Gaza, but because it prioritizes international law. Armenia, France, Canada, India and dozens of other countries are working to bring the Jewish and Turkish worlds into conflict. “The tension with Israel provides an opportunity for forces that want to undermine Azerbaijani-Turkish relations. Against the backdrop of the rising tide of anti-Semitism in the world, it is not easy to have an exemplary attitude towards the Jewish community. Ilham Aliyev, the savior of Karabakh, is preventing new conflicts as the winner of the only war that ended with a complete and decisive victory after World War II. Azerbaijan is a safe home for the largest Jewish and Christian communities in the Islamic world. Our lands were liberated through the martyrdom of different nations and religions shoulder to shoulder.”

Committee Chairman Fazil Mustafa first congratulated Speaker Sahiba Gafarova on her successful visit to Uzbekistan. He then said that during the government’s report, he had raised the issue of dilapidated buildings. Immediately after this speech, Prime Minister Ali Asadov responded to him, and F. Mustafa expressed his gratitude for the prompt response. The deputy noted that the reality that about 16 thousand apartments had to be rebuilt in connection with dilapidated buildings had emerged. F. Mustafa recalled the fact that a citizen’s apartment was illegally demolished by a construction company some time ago. He added that not only the personal property of citizens, but also the interests of entrepreneurs should be discussed here. The deputy noted that it is necessary to draw attention to the problems faced by entrepreneurs during the construction of the planned 16 thousand apartments. “Many people have received permits with difficulty, but they cannot start work,” said F. Mustafa, adding that if they agree with 70 residents in one place, they cannot agree with the remaining two residents. According to the MP, problems with the optimal valuation issue are delaying the work. Therefore, the optimal price should be determined. That is, the minimum amount of funds should be offered so that construction work can begin immediately.

During the discussion of the issues on the agenda, the first item on the agenda was the draft law on the appointment of former military prosecutor Khanlar Valiyev as a judge of the Constitutional Court of the Republic of Azerbaijan. Speaker Sahiba Gafarova announced that a presentation on the issue had been sent to the Milli Majlis. After the presentation, the draft was put to a vote and adopted in one reading. After the Speaker’s congratulations, Khanlar Valiyev took the oath in the Milli Majlis.

Other issues on the agenda were related to the appointment of new judges to the Baku, Sumgayit, Sheki, and Shirvan Courts of Appeal. According to the draft, Zafar Ahmadov was appointed a judge to the Baku Court of Appeal. Orkhan Ismayilov, a judge of the Shirvan Court of Appeal, was dismissed from his position as a judge of that court and sent to the Baku Court of Appeal. Agil Alisa oglu Musayev, a judge (chairman) of the Fuzuli District Court, was appointed a judge of the Baku Court of Appeal due to the change of position.

According to the draft, the following judges were dismissed from their positions as judges of the Baku Court of Appeal due to the change of their positions:

– Allahverdiyev Elbey Hidayat oglu;

– Eyyubov Farid Ilham oglu;

– Sariyev Khayal Ajdar oglu.

At the same time, according to the draft, their positions were changed, and judge Kamran Mukhtarov of the Baku Grave Crimes Court and judge Elchin Mammadov of the Sumgayit Grave Crimes Court were appointed judges to the Sumgayit Court of Appeal.

Also, their positions were changed and Vugar Musayev, judge of the Sheki Administrative Court, and Taleh Musayev, judge of the Shamkir District Court, were sent to the Sheki Court of Appeal.

In accordance with the project, Ali Aliyev, judge of the Lankaran Grave Crimes Court, Javid Sultanov, judge of the Agdash District Court, Jeyhun Guliyev, judge of the Masalli District Court, and Mirlatif Sadigov, judge of the Saatli District Court, whose positions were changed, were appointed judges of the Shirvan Court of Appeal.

Elshad Ibish oglu Aliyev was dismissed from his position as a judge of the Shirvan Court of Appeal due to a change in his position.

The issues were put to a vote and adopted.

The meeting discussed amendments to the laws “On Approval of the Regulations on Military Service” and “On Military Duty and Military Service”. According to the draft, in addition to the army general, there will be no age limit for the head and deputy head of the relevant executive authority and other state bodies (except for those included in the structure of state bodies) appointed to the position by the relevant executive authority, which provides for military service in addition to the Armed Forces of Azerbaijan.

The amendments also state that those persons who have exceeded the age limit for active military service or reserve service are released from active military service to reserve service or resign due to age when they are dismissed from their positions. The draft law envisages expanding the circle of persons for whom the age limit for active military service is not determined. According to the proposed amendment, in addition to the army general, the age limit will not be determined for the heads and deputies of relevant state bodies appointed to the position by the President of Azerbaijan.

The draft law on amendments to the Code of Administrative Offenses, which was discussed at the plenary session, also reflected important issues. Thus, fines for violating flight safety rules are being expanded. According to the draft law, individuals will be fined 3,000 manats, officials 5,000 manats, and legal entities 10,000 manats for setting off pyrotechnic products without a proper permit or constructing facilities that contribute to the mass gathering of birds dangerous to aircraft flights. Individuals will be fined 3,000 manats, officials 5,000 manats, and legal entities 10,000 manats for any kind of fire, rocket launch, explosion work, and other such work that may pose a threat to flight safety without the necessary permit. According to the current legislation, a fine of 100 manats is applied. A fine of 600 manat shall be imposed for removing or taking away any element of an aircraft or items (cargo, baggage) found at the scene of an aviation accident or incident without the consent provided for in the Law “On Aviation”. According to the current legislation, a fine of 500 manat shall be imposed for removing any part of an aircraft or items (cargo, baggage) that has crashed at the scene of an aviation accident without the permission of the commission investigating the aviation accident. For failure to ensure the internal regime and failure to comply with the exit regime by enterprises, institutions and organizations located on the territory of the airport (airport) and their employees, individuals shall be fined 500 manat, officials shall be fined 2,000 manat, and legal entities shall be fined 5,000 manat. According to the current legislation, officials shall be fined 500 manat, and legal entities shall be fined 1,000 manat.

For violation of the rules for inspection and inspection of aircraft, individuals will be fined 500 manats, officials 1,000 manats, and legal entities 3,000 manats. According to the current legislation, officials are fined 1,000 manats. For failure to transmit initial information on passengers and crew members of the aircraft and registration data of passenger names by aircraft operators in real-time electronic form through the “single window” system for passenger information to the body (organization) determined by the relevant executive authority, individuals will be fined 2,000 manats, officials 5,000 manats, and legal entities 20,000 manats.

Individuals will be fined 5,000 manats, officials 10,000 manats, and legal entities 50,000 manats for operating aircraft belonging to the Republic of Azerbaijan without state registration or state registration of aircraft belonging to a foreign state.

The bill was put to a vote and passed on third reading.

According to the proposed amendments to the Code of Administrative Offenses of the Republic of Azerbaijan, the laws “On State Duty” and “On Licenses and Permits”, the activity of gas filling facilities will also be included in the type of activity requiring a license. Taking into account the characteristics of gas filling and gas supply facilities, a number of requirements are established in relation to the type of activity provided for in Article 10 of Appendix No. 1 to the Law. When issuing a license for this type of activity, a requirement is established that a license agreement be concluded between the licensee and the licensing authority within 30 days from the date of issuance of the license, otherwise the license will not have legal consequences. Accordingly, a state fee is established for the operation of gas filling and gas supply facilities. According to the draft, a state fee of 1,100 manat is established for issuing a license for the installation of gas filling and gas supply facilities, and a state fee of 2,500 manat is established for issuing a license for the operation of gas filling and gas supply facilities.
